Oman has announced that, as of January 2021, expatriate residents in the Sultanate will be able to change jobs without the need to seek approval from their current employer (sponsor) before being allowed to switch employment in the Sultanate.
In a circular issued today [Sunday, June 7], the Inspector General of Police and Customs, His Excellency Lieutenant-General Hassan bin Mohsen Al-Shariqi, has issued Decree No. 157/2020 which amends certain provisions to the executive regulations of the Foreigners Residence Law, issued by Royal Decree 40/15, published in the Official Gazette.
As per the amendments, they are as follows:
Article 1 will replace the text of Article 14 of the executive regulations of the Foreigners Residence Law.
The resident visa of expatriates may be transferred between employers who have a license to recruit workers, on the condition that the evidence of expiry of contract, termination, or termination of employment contract is presented.
There is approval by the relevant government authority on the second employer’s contract with the expatriate, as per the regulations determined by the relevant authority.
The transfer of the expatriate’s resident permit shall also transfer the residence permits of his family members who are under it to the owner.
Until the necessary procedures for their residency are met, and transfer procedures completed to the second employer, the first employer will remain responsible for all requirements related to the residency of the expatriate.
Anything found to be in violation of this decision or goes against its provisions is canceled.
Article 3 states that this decision will be published in the Official Gazette and will be implemented from January 1, 2021.
